Services provided by the North Pennines AONB Partnership
The Partnership permits each Participating Organisation to construct and maintain one website within the North Pennines Website. The Partnership will provide, free of charge, to the Participating Organisation, the use of such software and related technical information ("the North Pennines AONB Partnership Software") which the North Pennines AONB Partnership in its absolute discretion, deems necessary to enable that Participating Organisation, to construct and maintain such website.
The North Pennines AONB Partnership Software can be used by the Participating Organisation only for the purpose of constructing and maintaining a Member Site.
The Participating Organisation shall not provide or disclose the North Pennines AONB Partnership Software to any third party or permit any third party to use it.
Participating Organisation's Obligations
Each Participating Organisation (PO):-
- PO shall create a website relating to its organisation or group [its Member Site] as part of the North Pennines Website, as soon as reasonably practicable after becoming a Participating Organisation and thereafter shall maintain its Member Site;
- PO shall follow any guidelines which the North Pennines AONB Partnership provides to it in relation to the form, layout and content of its Member Site;
- PO shall obtain the North Pennines AONB Partnership's prior written approval to any terms and conditions which it intends to use at the Member Site;
- PO shall inform the North Pennines AONB Partnership of any complaint it receives about its Member Site;
- PO shall remove, at the request of the North Pennines AONB Partnership, any links on the Member Site to any sites which the North Pennines AONB Partnership reasonably believes are inappropriate;
- PO shall not disclose to any third party its password, or any other security devices or mechanisms provided to it by the North Pennines AONB Partnership in relation to its Member Site or otherwise knowingly do anything which would enable a third party to alter, add to or delete a Member Site without the prior written consent of the North Pennines AONB Partnership;
- PO shall if it runs a bulletin/discussion board on its Member Site, impose such conditions of use on the bulletin/discussion board as the North Pennines AONB Partnership may request and make such amendments to such conditions as the North Pennines AONB Partnership may request from time to time.
The Participating Organisation acknowledges that the North Pennines AONB Partnership has access to the Member Site.
If the Participating Organisation no longer wishes to maintain its Member Site, it shall give the North Pennines AONB Partnership not less than 1 week's prior written notice. At the expiry of the notice, the North Pennines AONB Partnership shall remove the Member Site from the North Pennines Website.
Rights of the North Pennines AONB Partnership
The Partnership retains the right, in its sole discretion, to refuse to allow any party to build a Member Site. The Participating Organisation acknowledges that the North Pennines AONB Partnership has access to the Member Site.
The Partnership, may, in its sole discretion, at any time, without liability to the Participating Organisation, delete any Member Site from the North Pennines Website, prevent access to a Member Site or make any amendments or additions to the material contained on a Member Site.
Contents of Member Site
The Participating Organisation undertakes and warrants to the North Pennines AONB Partnership that:-
- it either owns the copyright in the content of its Member Site or else has the right to use the content of its Member Site;
- the content of its Member Site does not and will not consist of any material which, or the accessing of which, is offensive, pornographic, unlawful, defamatory or obscene;
- the content of its Member Site does not and will not contain any material which infringes any copyright or other intellectual property rights or rights to confidential information belonging to third parties or any other third party rights whatsoever;
- the content of its Member Site does and will comply with all applicable law and regulations; and
- the content of its Member Site is and will be accurate and not misleading.
In operating its Member Site and any bulletin board forming part thereof, the Participating Organisation shall comply with its obligations under the Data Protection Acts 1984 and 1998 and other similar statutory provisions enforceable from time to time in other parts of the world.
These Conditions may be amended from time to time by the North Pennines AONB Partnership by means of e-mail notice. The Participating Organisation shall be bound by such amended Conditions unless it sends the North Pennines AONB Partnership a cancellation notice pursuant to Condition 3.
